The following Siemens Technologies S.A.E training terms and conditions are integral part of this offer as well as the following training terms and conditions. Your purchase order must include your acceptance to our offer including its terms and conditions.

1. Prices
The quoted prices do not include Sales Tax.
We are applying the tax advance payment system and accordingly no Withholding Tax should be deducted.
The offered prices are valid under the present customs and taxes regulations, we reserve the right to amend our prices, should these revealing regulations change.
For Training courses outside Egypt we are not responsible for Air tickets, Hotel accommodation, Visa, …etc

2. Payment
Payment to be made 100% in advance.
Payment though bank transfer or deposit. Our bank details will follow with order confirmation.

3. Enrollment Confirmation
Enrollments are tentative and may be forfeit until receiving your official purchase order in all technical and commercial aspects, Advance Payment, if any, and our order acceptance confirmation.

4. Right of Withdrawal and Discontinuation
Siemens can withdraw from the contract if the training measures have to be cancelled due to illness of the trainer or for technical reasons or for reasons for which Siemens is not responsible.

 

Before exercising this right of withdrawal, Siemens will try to arrange for another suitable employee to carry out the training measure or to rearrange the course for another date, provided this is possible and the customer agrees.

 

Siemens will inform the customer of such changes without delay.

In the event of Siemens withdrawing, the customer will be reimbursed for any payment made in advance for the cancelled training measures. The customer shall have no other claims or rights as a result of withdrawal.


For reschedule/cancellation the training course the following reschedule/cancellation fees apply:

 

  • Within (15) working days, reschedule/cancellation fees amount to be 100% of the training course value
  • From (16) to (25) working days, reschedule/cancellation fees amount to be 50% of the training course value
  • No fees will be charged where more than (25) working days written notice sent to SIEMENS.

 

In case a participant discontinues a course at any time, 100% of the agreed total price for the training measures will be charged.

5. Copyrights
Siemens grants the customer the non-exclusive right to use the hardware and software products supplied to him and/or the hardware and software made available to him during the courses in unchanged form and exclusively for training purposes.

 

The customer shall not remove, reverse-engineer or decompile the software products provided for training purposes, and shall not copy or disassemble parts of the software programs or utilize them in any other, unauthorized way.

 

The customer shall also not copy, reprint or translate, either in full or in extract form, any course documentation and training material provided to the customer (hereinafter referred to as “Documentation”). Dissemination, exploitation and disclosure of the contents of the Documentation is prohibited to the customer.

6. Validity Time
The offer is valid for one month from the date of sending the offer.

7. Training Time

Training time: 9:00 am - 4:00 pm, training time during Ramadan: 9:00 am - 2:30 pm

1. Compliance with Export Control Regulations

1.1. If Purchaser transfers goods (hardware and/ or software and/ or technology as well as corresponding documentation, regardless of the mode of provision) delivered by Siemens or works and services (including all kinds of technical support) performed by Siemens to a third party worldwide. Purchaser shall comply with all applicable national and international (re-) export control regulations.

 

1.2. If required to conduct export control checks, Purchaser,upon request by Siemens, shall promptly provide Siemens with all information pertaining to particular end customer, destination and intended use of goods, works and services provided by Siemens, as well as any export control restrictions existing.

 

1.3. Purchaser shall indemnify and hold harmless Siemens from and against any claim, proceeding, action, fine, loss, cost and damages arising out of or relating to any noncompliance with export control regulations by Purchaser, and Purchaser shall compensate Siemens for all losses and expenses resulting thereof, unless such noncompliance was not caused by fault of the Purchaser. This provision does not imply a change in burden of proof.

 

1.4. Please note that the delivery of our offer content is subject to the Export Control Regulation, which may lead to extended delivery period or cancelation of some or all of the order items without your prior approval and without any impact on Siemens.
 

2. Reservation Clause

Siemens' obligation to fulfill this agreement is subject to the proviso that the fulfillment is not prevented by any impediments arising out of national and international foreign trade and customs requirements or any embargos and/or other sanctions.

3. Destination Control Statement (DCS)

Goods labeled with “AL” not equal to “N" are subject to European or German export authorization when being exported out of the EU.
